Under the law, all Discretionary Trusts, Unit Trusts and Fixed Unit Trusts established in NSW, NT or Victoria needs to be duty stamped upon execution. 

Trust deed stamping is a process to officially create the trust entity. All Discretionary Trusts, Unit Trusts and Fixed Unit Trusts established in NSW, NT or Victoria needs to be duty stamped upon execution. While establishing your trust deed, it is important to check the stamping requirements of the respective state jurisdiction as these may change.

 

What is the time-frame for stamping deeds?

As per legislation, Taxpayers must lodge the trust deeds established in following jurisdictions:

- NSW  - Within 3 months of the date of execution of the trust

- Victoria – Within 30 days of the date of execution of the trust

 

What happens if a trust deed is not stamped?

If you do not get your trust deed stamped within the relevant time frame, there may be late fees and penalty interest payable to the relevant office of state revenue.

- Post / Mail: Send us the signed / executed copy of Trust deed to PO Box 7963 Baulkham Hills NSW 2153 with a return paid envelope

Please note, Individual Trustees need to provide a valid proof of photo identification for ID verification.

 

Turnaround Time?

Stamping for NSW: For Walkin clients, we can lodge the applications instantly on receipt of your payment and the signed / executed trust deed copy and handover the stamped trust deed to you.

For all stamping requests received via email, we will lodge the application instantly and email back the Duties Notice of Assessment certificate to you.

For all stamping requests received via post, we will lodge the application instantly and return the post to you within 1 business day.

 

Stamping for VIC: We will lodge the applications instantly and provide the transaction reference number on email to you. Please note VIC SRO usually provides the certificate of duty within 3 busienss days after the lodgement. 

 

The Duties Notice of Assessment certificate provided by Office of State Revenue should be kept with the signed / executed trust deed throughout the life of the trust as it acts as an evidence of stamping lodgement.

 

How much does it Cost?

Our Stamping Fee is $70 (incl. GST) plus the applicable duty payable for the state as follows:

NSW: $500 (if stamped within 3 months)

VIC: $200 (if stamped within 30 days)
