Order NowWe offer stamping of Bare Trust deeds (Also known as Property custodian trust deed) which are set up for Limited Recourse Borrowing Arrangements (LRBA) when Self Managed Superannuation Funds (SMSF’s) borrow. Currently stamping is required for deeds executed in New South Wales (NSW) and Victoria (VIC).
NSW – $750 Duty Payable under Section 62B
Stamping Fees - Our Fee: $660 (incl. GST) + OSR Fees
In New South Wales, duty is payable on Bare Trust deeds and to ensure the deed is stamped correctly, you must lodge the deed through a Revenue NSW (OSR) agent though OSR public lodgement system.
As a registered agent of Revenue NSW, we can stamp the deed for you for a fixed fee of $660 (GST inclusive), plus the applicable OSR duty payable. The duty is $750 for deeds executed on or after 1st February 2024.
We need the following documents to comply with Duties Act evidentiary requirements of Section 62, 62A, 62B:
- Original executed Bare Trust Deed (also known as Property Custodian Trust Deed). If the deed has wet signature, then original deed should be sent to us at PO BOX 7963 Baulkham Hills NSW 2153. If the deed has digital signature, then it should be email to us at stamping@trustdeed.com.au. We physically stamp the original deed and return the original back to you via secure mail. Alternatively, you can send a representative to our office with an appointment.
- Copy of any deeds of amendment / variation to the Bare Trust Deed
- Stamped Front Page of the Contract for Sale of Land, that has been stamped with ad valorem duty. If the contract of sale is not stamped, we will need evidence that the stamp duty has been paid on purchase of land. Scanned copy of the original document is acceptable.
- Bank Statements of the fund (Self-Managed Superannuation Fund), confirming the deposit for property acquisition and settlement of the purchase price – note that the bank account should be in the name of Trustees of the SMSF ATF the SMSF. Scanned copy of the original bank statement or a screenshot of online statement is acceptable, however spreadsheet exported from online bank statement is not acceptable.
- Loan Agreement Copy from the lender for the balance amount (or loan approval letter if finance is pending)
- Property Custodian Trust Corporate Trustee details
1. Correspondence address of all directors and shareholders
2. Contact phone number and email address of each officeholder (director) and shareholder
3. Certified photo ID for all directors (e.g., passport or NSW driver’s license)
- Completed Purchaser/Transferee Declaration Form:
VIC – NIL Duty Payable, however Lodgement Required

In Victoria, no duty is payable for Bare Trust deeds. However, the Deed needs to be lodged with the State Revenue Office (SRO). The process involves lodging the Deed through us acting as your SRO agent using Duties Online or through the SRO’s public lodgement system.
We can facilitate this for you quickly and efficiently. For Victorian lodgement, we require the following documents:
1. Scanned Copy of the Executed Bare Trust Deed (Wet signature or digital signature)
2. Signed Declaration stating that the Deed was executed in Victoria
